    This Privacy Policy explains how PropScan LLC (“PropScan,” “we,” “us,” or “our”) collects, uses, discloses, retains, and protects information in connection with the PropScan website, applications, data products, property-intelligence tools, communications, subscriptions, and related services (collectively, the “Platform”).

    This Policy is designed to be transparent while preserving PropScan’s ability to operate, improve, secure, monetize, and defend the Platform to the fullest extent permitted by applicable law. It should be read together with the PropScan Terms of Service.

    1. Who we are and scope

    PropScan LLC operates the Platform at https://propscan.cr and related domains or product interfaces. The Platform may provide property search, listing aggregation, registry or source references, market intelligence, geospatial displays, analytics, estimates, alerts, and AI-assisted summaries or recommendations relating to properties in Costa Rica.

    This Policy applies to information collected through the Platform and through communications with us. It does not apply to third-party websites, property portals, public registries, payment processors, messaging tools, or external services that we do not control, even if the Platform links to or integrates with them.

    2. Eligibility and territorial limitation

    The Platform is intended only for visitors and residents of Costa Rica. By using the Platform, you represent that you satisfy this requirement.

    PropScan may use reasonable technical, contractual, account, payment, location, or other measures to assess or enforce this limitation, but we do not guarantee that all access outside the intended audience will be blocked.

    3. Information we collect

    3.1 Information you provide

    • Account and contact information, such as name, email address, telephone number, organization, role, username, password, and user preferences.
    • Subscription, billing, and transaction information, such as plan type, invoices, payment status, billing address, tax or compliance information, and payment confirmations. Payment card or bank details may be collected directly by our payment processors rather than by PropScan.
    • Property-related inputs, including finca numbers, folio real numbers, listing details, addresses, map pins, saved searches, comparables, notes, documents, photographs, user-generated descriptions, lead information, valuation requests, and due-diligence requests.
    • Communications and support content, including emails, chat messages, feedback, dispute notices, reports of inaccurate data, and survey responses.
    • Marketing preferences, event registrations, referral information, and consent records.

    3.2 Information collected automatically

    • Device, browser, log, cookie, and analytics information, such as IP address, device identifiers, browser type, operating system, session identifiers, referring pages, pages viewed, clickstream, timestamps, language, approximate location, and usage patterns.
    • Security and fraud-prevention information, including authentication events, access attempts, error logs, suspicious activity signals, and abuse-prevention data.
    • Approximate location or network information derived from IP address or device settings, where permitted, to support localization, security, eligibility enforcement, and service optimization.

    3.3 Public-source, third-party, and property data

    The Platform may ingest, compile, license, scrape, receive, infer, or display information from public records, listing feeds, brokers, agents, developers, registry records, maps, satellite or geospatial providers, analytics vendors, artificial-intelligence tools, users, and other third parties. Such information may include property descriptions, ownership or registry references, liens or encumbrance indicators, transaction history, listing status, prices, taxes, zoning or land-use indicators, coordinates, neighborhood attributes, photographs, and comparable-property data.

    Property data may be incomplete, delayed, incorrect, duplicated, changed by third parties without notice, or unavailable. Our processing of property data is primarily for providing and improving property-intelligence services, not for guaranteeing title, valuation, legal status, physical condition, investment outcome, or market availability.

    4. How we use information

    • Operate, provide, maintain, authenticate, secure, and administer the Platform and user accounts.
    • Create, display, enrich, rank, filter, score, summarize, or analyze property listings, public-source records, comparable properties, maps, alerts, and market information.
    • Process subscriptions, payments, renewals, invoices, refunds when applicable, and customer support requests.
    • Personalize features, recommendations, saved searches, alerts, and user experience.
    • Develop, test, train, evaluate, monitor, and improve data models, artificial-intelligence systems, analytics, search functions, matching tools, valuation tools, and anti-abuse systems.
    • Communicate with you about account activity, product updates, support, security, legal notices, marketing, events, and service changes.
    • Measure usage, performance, conversion, marketing effectiveness, reliability, and product-market fit.
    • Detect, investigate, prevent, or respond to fraud, scraping, unauthorized access, misuse, security incidents, disputes, chargebacks, violations, and unlawful activity.
    • Comply with legal obligations, enforce contracts, preserve evidence, defend claims, and protect the rights, property, safety, reputation, and business interests of PropScan, users, partners, and the public.
    • Carry out any other purpose disclosed at the time of collection or otherwise permitted by applicable law.

    5. Legal bases and consent

    Where Costa Rica Law No. 8968 and related regulations apply, PropScan processes personal information based on one or more recognized grounds, including your informed consent, the performance of a contract or pre-contractual request, compliance with legal obligations, information obtained from publicly accessible sources, and other grounds permitted by applicable law.

    By using the Platform, submitting information, creating an account, purchasing a plan, requesting support, or opting in to communications, you consent to the collection, use, retention, disclosure, and international transfer of information as described in this Policy, to the fullest extent permitted by applicable law. You may withdraw consent where legally available, but withdrawal will not affect processing already carried out and may limit or prevent our ability to provide the Platform.

    6. Cookies, analytics, and similar technologies

    We and our service providers may use cookies, pixels, local storage, SDKs, analytics scripts, device identifiers, and similar technologies to remember preferences, keep you signed in, measure usage, support security, improve performance, personalize content, and understand marketing effectiveness. Browser or device settings may allow you to block or delete some technologies, but doing so may affect Platform functionality.

    7. How we disclose information

    • Service providers and processors that host, store, analyze, secure, develop, support, bill, process payments, communicate, or otherwise help operate the Platform.
    • Property-data, mapping, analytics, AI, listing, CRM, payment, verification, communications, and infrastructure partners where useful to provide or improve the Platform.
    • Professional users, brokers, agents, developers, sellers, buyers, landlords, or other counterparties when you request introductions, submit leads, publish listings, share materials, or otherwise direct us to disclose information.
    • Affiliates, successors, assigns, investors, advisors, and business transaction participants in connection with financing, diligence, reorganization, merger, sale, acquisition, bankruptcy, or transfer of all or part of our business or assets.
    • Government authorities, regulators, courts, law enforcement, claimants, counterparties, or legal advisors where we believe disclosure is required or appropriate to comply with law, protect rights, enforce terms, prevent harm, respond to claims, or defend PropScan.
    • Other parties with your consent or as otherwise permitted by applicable law.

    We may disclose aggregated, de-identified, anonymized, or statistical information without restriction where it does not reasonably identify a specific individual, including for analytics, benchmarking, marketing, research, or commercial purposes.

    8. International transfers

    PropScan and its service providers may process information in Costa Rica and other countries where we or our vendors operate. These countries may have data-protection laws that differ from those in Costa Rica. By using the Platform, you consent to such transfers, storage, and processing, subject to safeguards we consider appropriate in the circumstances and to the extent required by applicable law.

    9. Retention

    We retain information for as long as reasonably necessary for the purposes described in this Policy, including to provide the Platform, maintain business records, comply with legal obligations, resolve disputes, enforce agreements, preserve audit trails, prevent abuse, improve models and analytics, and protect or defend PropScan. Because property and market intelligence may be historical, derivative, public-source, or aggregated, some records may be retained for extended periods where permitted by law.

    10. Security

    We use administrative, technical, and organizational measures designed to protect information against unauthorized access, loss, misuse, alteration, or disclosure. No system, transmission, or storage method is fully secure. PropScan does not guarantee absolute security and is not responsible for unauthorized access or events beyond its reasonable control, except where liability cannot be limited by applicable law.

    11. Your choices and rights

    Subject to applicable law and verification of your identity, you may request access, correction, deletion, objection, withdrawal of consent, or other legally recognized rights regarding your personal information. We may decline or limit requests where permitted by law, including where information is needed for legal compliance, fraud prevention, security, contractual performance, dispute resolution, historical records, public-source integrity, or the rights of PropScan or others.

    To exercise rights, contact us through support[at]propscan[dot]cr and include sufficient information for us to identify your account, verify your identity, understand the request, and respond lawfully. We may require additional verification before acting on a request.

    12. User submissions and publicly visible content

    If you submit listings, photographs, descriptions, comments, reviews, saved notes shared with others, or other content, that content may be visible to other users or third parties depending on the feature used. You are responsible for ensuring that you have the rights and authority to submit such content and any personal information it contains.

    13. Children

    The Platform is not intended for minors and may not be used by anyone under the age required to enter into binding agreements in their jurisdiction. We do not knowingly solicit personal information from children. If we learn that a child has provided information without required consent, we may delete it.

    14. Third-party links and services

    The Platform may link to or integrate with public registries, map providers, payment processors, property portals, messaging services, analytics providers, and other third-party services. Their practices are governed by their own terms and privacy policies. PropScan is not responsible for third-party practices, content, availability, accuracy, security, or compliance.

    15. Changes to this Policy

    We may update this Policy at any time. The “Last updated” date indicates the latest version. Changes are effective when posted, unless a later effective date is stated. Your continued use of the Platform after a change means you accept the updated Policy to the fullest extent permitted by law.
