These Terms of Service (“Terms”) govern access to and use of the PropScan website, applications, databases, dashboards, reports, APIs, property-intelligence tools, subscriptions, communications, and related services (collectively, the “Platform”) operated by PropScan LLC (“PropScan,” “we,” “us,” or “our”).
By accessing or using the Platform, you agree to these Terms. If you use the Platform on behalf of an entity, you represent that you have authority to bind that entity, and “you” includes that entity. If you do not agree, do not use the Platform.
The Platform is intended to be accessed and used by people who are residents of Costa Rica or who are visiting Costa Rica. By making use of the Platform, you confirm that you are either visiting Costa Rica or are a resident of Costa Rica.
You may not access or use the Platform from any jurisdiction where doing so would require PropScan to comply with laws, registrations, licensing, consumer-protection obligations, real-estate brokerage obligations, data-localization requirements, taxes, or regulatory regimes that PropScan has not expressly accepted in writing. PropScan may restrict, suspend, or terminate access based on location, account, billing, payment, network, legal, or risk signals.
PropScan is a property-intelligence and data platform focused on Costa Rica. The Platform may offer property search, listing aggregation, public-source or registry references, source trails, property maps, geospatial displays, market indicators, estimates, comparable-property information, alerts, AI-assisted summaries, investment or opportunity signals, lead tools, and other analytics.
The Platform is an information and technology service. Unless expressly stated in a separate written agreement signed by PropScan, PropScan is not acting as your broker, attorney, notary, surveyor, appraiser, lender, fiduciary, tax advisor, title insurer, escrow agent, investment advisor, or real-estate agent.
No legal, tax, investment, financial, title, engineering, architectural, appraisal, brokerage, or due-diligence advice is provided through the Platform.
You are solely responsible for retaining qualified Costa Rica professionals, including attorneys, notaries, surveyors, appraisers, engineers, architects, accountants, brokers, and other advisors, before making any property, investment, rental, purchase, sale, lending, development, or legal decision.
You must independently verify all information directly with official registries, counterparties, property owners, sellers, brokers, municipalities, utilities, professional advisors, site inspections, and other primary sources before relying on it.
No Platform output is a guarantee of title, ownership, encumbrance status, zoning, land use, tax status, permits, market value, investment return, availability, condition, rental income, transaction completion, or legal compliance.
The Platform may display or generate information from public records, third-party feeds, user submissions, brokers, agents, developers, map providers, AI systems, analytics vendors, automated collection tools, proprietary models, and other sources. PropScan does not control many of these sources and does not independently audit every item of information.
All property, listing, registry, market, valuation, comparable, availability, map, source-trail, legal-status, ownership, encumbrance, zoning, tax, permit, photograph, neighborhood, AI, ranking, scoring, and other data is provided “as is,” “as available,” and with all faults. It may be false, inaccurate, incomplete, outdated, delayed, duplicated, mistranscribed, mistranslated, misclassified, unavailable, or changed without notice.
This disclaimer applies regardless of whether the information is provided for free, behind a paywall, in a paid subscription, in a report, in a custom analysis, through an API, in an email, through customer support, or through any other Platform feature.
PropScan has no obligation to update, correct, monitor, preserve, or continue providing any specific data, listing, report, estimate, feature, data source, or methodology. We may add, remove, modify, reprocess, relabel, or withhold data at any time.
Some features may require payment, subscription, usage credits, or a separate order form. Fees, limits, included features, renewal periods, taxes, and cancellation terms may be presented at checkout, in an order form, or inside the Platform. Unless otherwise stated in writing, fees are non-refundable, non-cancellable for the current billing period, and payable in advance.
PropScan may change pricing, plans, features, usage limits, or billing practices at any time. Continued use after changes take effect constitutes acceptance. You are responsible for applicable taxes, payment processor fees, chargebacks, currency conversion, and any costs of collection arising from nonpayment.
You agree not to:
You retain ownership of content you submit to the Platform, subject to the rights granted here. You grant PropScan a worldwide, non-exclusive, royalty-free, sublicensable, transferable, perpetual, irrevocable license to host, store, reproduce, modify, translate, analyze, classify, train models with, display, publish, distribute, create derivative works from, and otherwise use your submissions to provide, improve, secure, commercialize, and promote the Platform and related services, subject to applicable law and our Privacy Policy.
You represent and warrant that you have all rights, permissions, consents, and legal authority necessary for any content or data you submit, and that such content is accurate to the best of your knowledge and does not violate law, contracts, confidentiality duties, privacy rights, intellectual-property rights, or third-party rights.
The Platform, including software, interfaces, designs, databases, compilations, rankings, scores, models, algorithms, reports, dashboards, text, graphics, logos, trademarks, workflows, and proprietary methods, is owned by PropScan or its licensors and is protected by intellectual-property and other laws. Except for the limited right to use the Platform as permitted by these Terms, no rights are transferred to you.
You may not remove proprietary notices, misuse trademarks, copy Platform structure or data compilations, or use Platform materials outside the ordinary intended use without written permission.
The Platform may rely on, link to, or integrate with public registries, mapping services, payment processors, analytics providers, AI providers, brokers, agents, listing portals, communication tools, and other third parties. Third-party services and sources are not controlled by PropScan. PropScan is not responsible for their content, data, accuracy, availability, pricing, security, privacy practices, terms, outages, errors, or changes.
To the maximum extent permitted by law, the Platform and all data, outputs, reports, features, and services are provided “as is,” “as available,” and “with all faults,” without warranties of any kind, whether express, implied, statutory, or otherwise. PropScan disclaims all warranties, including merchantability, fitness for a particular purpose, title, non-infringement, accuracy, completeness, timeliness, reliability, availability, profitability, and uninterrupted or error-free operation.
PropScan does not warrant that the Platform will identify all relevant properties, risks, liens, restrictions, title issues, zoning matters, price changes, fraud risks, or market conditions; that any property will be available; that any transaction will close; that any valuation or estimate will be accurate; or that any user will achieve a desired result.
To the maximum extent permitted by law, PropScan and its affiliates, members, managers, officers, directors, employees, contractors, licensors, vendors, data providers, and agents will not be liable for any indirect, incidental, consequential, special, exemplary, punitive, lost-profit, lost-revenue, lost-data, business-interruption, reputational, investment, property, due-diligence, transaction, title, market, or reliance damages, even if advised of the possibility of such damages.
To the maximum extent permitted by law, PropScan’s aggregate liability for all claims arising out of or relating to the Platform or these Terms will not exceed the greater of: (a) the amount you paid to PropScan for the specific paid service giving rise to the claim during the three months before the event giving rise to liability; or (b) USD $100. The limitations apply regardless of theory, including contract, tort, negligence, strict liability, statute, equity, or otherwise.
You agree to defend, indemnify, and hold harmless PropScan and its affiliates, members, managers, officers, directors, employees, contractors, licensors, vendors, data providers, payment processors, and agents from and against all claims, demands, suits, proceedings, investigations, losses, liabilities, damages, judgments, fines, penalties, settlements, costs, and expenses, including reasonable attorneys’ fees, arising out of or relating to:
PropScan may control the defense and settlement of any indemnified matter at your expense. You may not settle any matter in a way that imposes obligations, admissions, restrictions, or liability on PropScan without PropScan’s prior written consent.
Some features may be labeled or function as beta, preview, AI-assisted, automated, or experimental. Such features may be inaccurate, unstable, biased, incomplete, or discontinued at any time. You are solely responsible for reviewing and validating outputs before use. AI or automated outputs are not professional advice, official records, or guaranteed facts.
PropScan may suspend, limit, or terminate your access at any time with or without notice if we believe your use creates legal, security, operational, financial, reputational, data-source, or business risk; if you violate these Terms; if payment fails; if a data source requires restriction; or if we discontinue a feature or service. You may stop using the Platform at any time. Upon termination, rights granted to you end, but provisions intended to survive will survive, including ownership, disclaimers, limitations of liability, indemnity, payment obligations, dispute terms, and restrictions on data misuse.
Our Privacy Policy explains how we collect, use, disclose, and retain information. By using the Platform, you consent to the Privacy Policy and to the processing of information as described there.
PropScan may modify, suspend, discontinue, replace, or restrict any part of the Platform or these Terms at any time. Updated Terms are effective when posted or otherwise made available, unless a later date is stated. Continued use after changes become effective constitutes acceptance.
Unless a separate signed agreement states otherwise, these Terms are governed by the laws applicable to PropScan LLC without regard to conflict-of-law principles, except that mandatory consumer or data-protection laws applicable in Costa Rica may apply where they cannot be waived. To the fullest extent permitted by law, claims must be brought individually and not as a class, collective, consolidated, representative, or private-attorney-general action.
Before filing a claim, you agree to first contact PropScan through the Platform’s contact methods and attempt in good faith to resolve the dispute informally for at least thirty days, unless urgent injunctive relief is reasonably necessary.
